rests on Struan Jacobs's (Tier 2) finding that the term "spontaneous order"
does not appear in Hayek's own writing until *The Constitution of Liberty*
(1960), used on only two pages, one of them reproducing a passage from
Polanyi's *The Logic of Liberty*. The priority claim — Polanyi in print with
the phrase in 1948, more than a decade before Hayek — is load-bearing and
memorable, and its negative half (Hayek *not* using it earlier) rests on one
scholar's reading.

**Why it matters.** Priority-of-first-use claims are exactly the kind that
turn out to have an unchecked earlier counterexample. "Spontaneous order" is
popularly attributed almost entirely to Hayek; a claim reversing that
attribution should stand on a direct read, not a single secondary.

**What would answer it.**
- A direct read of Hayek's *The Constitution of Liberty* (1960) confirming the
  two-page use and the Polanyi-reproducing passage Jacobs describes.
- A check of Hayek's earlier work for any pre-1948 or 1948–1960 use of the
  exact phrase — candidates include "Economics and Knowledge" (1937), "The Use
  of Knowledge in Society" (1945), *Individualism and Economic Order* (1948),
  and "The Results of Human Action but not of Human Design." Hayek's own later
  essays credit the *idea* to the Scottish Enlightenment; the question is the
  *phrase*.
- Note that Jacobs separately reports Polanyi credited Gestalt psychologist
  Wolfgang Köhler, not the Scottish Enlightenment, for his own "dynamic order"
  terminology in a 1941 essay — a genealogy worth confirming alongside.
