Executive Order 11858
The 1975 executive order, signed by President Gerald Ford, that created the Committee on Foreign Investment in the United States (CFIUS) as an interagency body with power only to advise the president — not to block, condition, or unwind a foreign acquisition on its own authority.
Matters to this vault as the foundational instrument the entire Fujitsu-Fairchild/Fairchild thread measures itself against: CFIUS's advisory-only design under this order is the specific structural gap Fujitsu's 1987 Fairchild bid exposed, and that the 1988 Exon-Florio Amendment was written to close by giving the president explicit block authority without a national-emergency declaration.
